Terms for ecommerce stores (EU)

1. What Eskotin is for your brand

Eskotin is a community and marketplace for climbers, operated from the European Union. Brands and ecommerce stores can publish products, one-off deals, outlet drops, mega deals and last-units offers to reach a qualified audience. Eskotin acts as a discovery and community channel; the sale and the contract with the end buyer are completed on your own website (or the point of sale you indicate).

2. Pricing rule

The price you publish on app.eskotin.com must be strictly lower than the public price of the same product on your own website or any other direct channel of yours at that time.

  • The recommended minimum difference is 5%, but the exact gap is up to you.
  • Prices must be shown VAT included, in euros (€), in line with EU consumer protection rules.
  • If a struck-through previous price is shown, it must match the lowest price applied on your site in the previous 30 days (EU Directive 2019/2161 - "Omnibus").
  • Publishing the same or a higher price will lead to removal of the listing without prior notice.

3. Stock, availability and last units

You are responsible for keeping each listing's stock up to date. If a product sells out, you must mark it as sold out or remove the listing within 24 hours. "Last units" notices must be real and verifiable; misleading claims may constitute unfair commercial practices under Directive 2005/29/EC.

4. Sales tracking and attribution

Every click from Eskotin to your site is logged with a referral identifier. Your site must receive and preserve that parameter so sales attributed to Eskotin can be counted. There are two options:

  1. UTM/ref parameter in the link: Eskotin appends ?ref=eskotin&utm_source=eskotin to the outbound URL. You must preserve it until purchase confirmation.
  2. Pixel or webhook: you can add a small snippet on your confirmation page that notifies the sale to Eskotin, or configure a webhook from your ecommerce.

5. Commission on attributed sales

Eskotin charges a 7% + VAT commission on the net amount (excluding VAT and shipping) of each verifiably attributed sale.

  • Attribution is calculated with the ref=eskotin parameter or your store's webhook/pixel.
  • Settlement is monthly. Eskotin invoices your legal entity from Spain; if you operate in the EU with a valid VAT number and the transaction is reported as intra-community (VIES), the invoice is issued under the reverse-charge mechanism.
  • Returns and cancellations are deducted from the next settlement.

6. Consumer rights: withdrawal, warranty and after-sales

As the seller you are solely responsible towards the end buyer. You must respect the rights EU law grants consumers, including:

  • Right of withdrawal of 14 calendar days with no need to give reasons (Directive 2011/83/EU).
  • Legal conformity warranty of at least 2 years on goods (3 years in Spain for goods bought from 2022, Law 3/2014 and RDL 7/2021).
  • Clear pre-contractual information: seller identity, total price including taxes, shipping costs, delivery times and returns policy.

Eskotin may mediate in a dispute but is not a party to the sales contract.

7. Data protection (GDPR)

We process brand data in accordance with Regulation (EU) 2016/679 (GDPR) and Spanish LOPDGDD. Eskotin is the data controller. Your brand's contact details are used to manage the commercial relationship, settlements and partnership communications. You can exercise your rights of access, rectification, erasure, portability, objection and restriction by emailing partnerships@eskotin.com. Where your brand processes data of end buyers referred from Eskotin, your brand acts as an independent controller for that data.

8. Brand, images and content

By publishing on Eskotin you declare that you hold the rights to the images, trademarks and descriptions used. You authorise Eskotin to display that content within the platform and in community promotional materials (newsletter, social media, notifications).

9. Collaborations with creators

Eskotin may facilitate contact between brands and community creators for collaborations. The financial terms of each collaboration are the sole responsibility of the parties. Eskotin does not charge for introductions but may apply a commission on deals signed through its sponsorship marketplace.

10. Suspension and termination

We may suspend or remove a listing or a brand account for breaching the pricing rule, misleading information, unreal stock or any practice that harms community trust. You can request termination at any time by emailing partnerships@eskotin.com.

11. Governing law and jurisdiction

These terms are governed by Spanish and European Union law. For any dispute between Eskotin and the brand, the parties submit to the courts of the city where Eskotin has its registered office, unless mandatory rules provide otherwise.

12. Changes and contact

These terms may be updated. Material changes will be communicated at least 15 days in advance. For any question, email partnerships@eskotin.com.

Acceptance

Express acceptance of these terms is mandatory before publishing or promoting products on Eskotin. The acceptance checkbox appears in the last step of brand onboarding; the date and version of the accepted terms are recorded. You can revoke your acceptance by requesting termination as described in section 10.
